Foreword:

Our mission is to help people help other people find great jobs, help Employers find great Candidates, and reward those that made it happen. P5Leader allows a ‘Referrer’ to search and forward jobs for consideration by ‘Referree’ (Candidate) to be submitted to an Employer. If the Employer is interested and ultimately hires the Candidate from P5Leader, the Referrer will be entitled to a percentage of the earned staffing fee or contract net profit margin, as defined in the Referrer Finder’s Fee Agreement section on the Terms & Conditions page. All users of the Platform have expressly made their information available to P5Leader. We have and reserve the right to use the information in the performance of the agreed upon staffing services. All users have the right to ‘Opt Out’ of P5Leader and thereby revoke the right to use said information going forward. Opt Out instructions can be found in every p5leader.com email we send, as well as on the User Profile page. We will not resell or otherwise provide your contact or related platform information to any 3rd-party not affiliated with P5Leader.  “P5Leader” (“Platform” or “P5Leader.com” or “We” or “Us”) Privacy Policy and “You” or “Your”:

Before accessing the  www.p5leader.com Platform, our software, data, solutions, services, or all other online & offline interactions with P5Leader, including without limitation to: platform data, email, phone, social media, chat, content, and audio/video conferencing, and other mediums, you accept and agree to be bound by this Privacy Policy. IF YOU DO NOT ACCEPT THIS PRIVACY POLICY, YOU ARE NOT AUTHORIZED TO USE THE P5LEADER PLATFORM.

You acknowledge:

(b) P5Leader Privacy Policy shall have the same force and effect as a signed agreement.

This Privacy Policy describes the information collected through your use of the Platform and related services, how P5Leader uses, shares, and protects it, as well as the choices you make about your information. Unless explicitly stated otherwise, any new features that augment or enhance the current Platforms and related services are subject to enforcement under this Privacy Policy.

We will notify you of material changes to this Privacy Policy by your provided email address. If your email address becomes invalid, we will also update this page to reflect any changes to the Privacy Policy. Please review the Privacy Policy each time You use the Service. BY USING THE SERVICE, YOU AGREE TO BE BOUND BY THE MOST RECENT VERSION OF THE PRIVACY POLICY.

About The Information We Collect

We collect information about and from You when You use the Platform, contact or interact with us, sign up for our newsletter or other mailing list, apply for employment with us, and voluntarily provide us with Your comments and other content in connection with using the Platform. As part of your access to and use of the Platform, we may collect: Your name, contact information including email address, telephone number, address, information included in employment applications, and any other information you voluntarily provide on the Platform. When You contact us, we may collect: Your name, contact information including email address, telephone number, and any other information that You voluntarily provide to us. When You access and use the Platform, we may automatically collect information regarding You and Your device, including Your device’s Internet Protocol address, the domain name of Your Internet service provider, your location, Your mobile device information (e.g. device model and operating system version), your page visits, your social media activity, and aggregated information that cannot be used to specifically identify You. Additional information collected is described in the Analytics and Cookies sections below. We may collect information about You from third party sources. The Platform provides links to our social media accounts, including but not exclusive to Facebook, Twitter, YouTube, LinkedIn, SnapChat and Instagram. If You connect with these websites through the Platform, we may receive personal information about You. We may also collect information about You from background check organizations that contain personal information in the public record prior to employment through this Platform. We may combine all information we collect from or about you and use it in the manner described in this Privacy Policy.

How We May Use Your Information

We use the information that we collect for the purposes for which You provided it, to effectively access and use the Platform, including:

  • To provide You support, services, help, etc.;
  • To process Your transactions and comments;
  • To send You information about P5Leader, staffing related opportunities and information we believe you would be interested in based upon Your self-defined user preferences;
  • For market research purposes to customize the Platform according to your interests;
  • To administer, operate, and improve the Platform or to further the mission of P5Leader,;
  • To personalize and enhance Your experience using the Platform;
  • To send periodic emails. The email address You provide may be used to send You news, updates, related solutions or service information, etc. Note: If at any time You would like to unsubscribe from receiving future emails. We provide details on how to Opt Out in each email We send You, as well as on Your Platform User Profile;
  • To generate and review reports and data about our user base and Platform usage patterns;
  • To analyze the accuracy, effectiveness, usability or popularity of the Platform;
  • To compile aggregate data for internal and external business purposes;
  • To prevent fraud and abuse of the Platform and to otherwise protect users and visitors and our business;
  • To assist law enforcement and respond to subpoenas; and
  • To perform other business activities as needed, or as described elsewhere in this Privacy Policy.
  • As explained elsewhere in this Privacy Policy, personal information We collect may be processed by our partners in providing services related to the Platform (such as administration services, technical services relating to the maintenance, servicing, and upgrading of software, hosting services, customer service, data migration services, payment processing services and analytical services, among others).

Legal Basis for Using Personal Identifiable Information (PII)

It is necessary to obtain, store and use your PII to perform the service and purpose of the Platform. You must complete Your user account registration where some PII must be provided to enable the use of your account. We may use your PII for our legitimate business interests. For example, We rely on our legitimate interest to analyze and improve our Platform and the content on our website, to send You notifications about our Platform, or to use your personal information for administrative, fraud detection, or legal purposes. You are giving complete consent to use Your PII prior to accessing the Platform and providing your personal data. You are free to withdraw your consent at any time, subject to the “Your Choices Regarding Your Information” section below and the preceding Legal Basis for Using PII in this Section. In compliance with all legal obligations, We may use your personal information to comply with legal obligations to which we are subject.

How Your Information is Disclosed

Information may be disclosed to third parties in accordance with our Privacy Policy. Please note that a user may choose not to share certain information as described in Your Choices Regarding Your Information below.

  1. Third Party Service Providers and Business Partners. We may use third party service providers and business partners to perform functions in connection with the Platform, such as email marketing, site analytics, social sharing, relationship management, functions related to analyzing and improving the Platform usefulness, reliability, user experience, and operation, storing data, and as otherwise described in this Privacy Policy. We also may share Your personal information with these providers and partners for their direct marketing and promotional purposes and so they can provide services to you.
    • By clicking on the Facebook button on the Platform, You will be automatically transported to the official Facebook Page for P5Leader, https://www.facebook.com/P5Leader. P5Leader allows users to comment on blog posts using the Facebook Comments Plugin and in doing so, P5Leader may have access to personal information about You.     • Additional Limits on Use of Your Google User Data: Notwithstanding anything else in this Privacy Policy, if you provide the Platform access to the following types of your Google data, the App’s use of that data will be subject to these additional restrictions: The Platform will only use access to read, write, modify, or control Gmail message bodies (including attachments), metadata, headers, and settings to provide a web email client that allows users to compose, send, read, and process emails and will not transfer this Gmail data to others unless doing so is necessary to provide and improve these features, comply with applicable law, or as part of a merger, acquisition, or sale of assets. The Platform will not use this Gmail data for serving advertisements. The Platform will not allow humans to read this data unless we have your affirmative agreement for specific messages, doing so is necessary for security purposes such as investigating abuse, to comply with applicable law, or for the Platform’s internal operations.
    • Google AdWords. Google AdWords is part of the DoubleClick/ Google Ad Manager advertising platform which creates, transacts, and manages digital advertising. Google AdWords tracks conversions specific to campaigns. Google AdWords sends cookies to browsers, and may store web requests, dates and times of web requests, IP addresses, browser types, and browser languages.     • We use IpInfo to monitor the Internet Protocol information of users of the Platform. In using our Platform, IpInfo may collect information about Your IP address. For more information on how IpInfo collects Your data, please visit  https://ipinfo.io/privacy-policy.
    • By clicking on the LinkedIn button on the Platform, You will be automatically transported to the official LinkedIn profile for P5Leader, https://www.linkedin.com/company/P5Leader-software-inc/.
    • We use Sentry to help monitor and fix errors in our Platform. In using our Platform, Sentry may collect your IP address and browser information. For more information on how Sentry collects Your data, please visit https://sentry.io/privacy/.
    • Twilio is a communications company that P5Leader uses in providing account verification by text messaging, and other communications. In using our Platform, Twilio may collect information about Your communications.   2. Payment Processing. Any payment information You provide through the Platform may be shared with and may be stored by our credit card processor, Stripe, and is subject to its privacy policy, including in the case of data breach.   3. Business Changes. If We become involved in a merger, acquisition, sale of assets, joint venture, securities offering, bankruptcy, reorganization, liquidation, dissolution, or other transaction or if the ownership of all or substantially all of our business otherwise changes, We may transfer Your information to a third party or parties in connection therewith.
  4. We may also share Your information with our affiliates for purposes consistent with this Privacy Policy. Our affiliates will be required to maintain that information in accordance with this Privacy Policy.
  5. Investigations and Law. We may disclose information about You to third parties if We believe that such disclosure is necessary to:

  7. We use third-party analytics tools to better understand who is using the Platform and how people are using it. These tools may use cookies and other technologies to collect information about Your use of the Platform and Your preferences and activities. These tools collect information sent by Your device or the Platform and other information that assists us in improving the Platform. This information may be used to analyze and track data, determine the popularity of certain content, and better understand Your online activity, among other things. We use Google Analytics to better understand who is using the Platform and how people are using it.   8. Cookies and Other Tracking Technologies We, along with third parties, use cookies, local storage objects, Web beacons and other technologies. These technologies are used for tracking, analytics and personalization and optimization of the Platform. Cookies are small files that are transferred to and stored on Your computer through Your Web browser (if You allow it) that enable the website’s or service provider’s system to recognize Your browser and capture and remember certain information. You can instruct Your browser to stop accepting cookies. But if You do not accept cookies, You may not be able to use all portions of all functionality of the Platform.
    • Persistent cookies remain on the visitor’s computer after the browser has been closed.
    • Session cookies exist only during a visitor’s online session and disappear from the visitor’s computer when they close the browser software.

Security

We implement a variety of security measures to protect the safety of Your PII when You create, access or submit your PII. We take reasonable measures to protect the information You submit via the Platform against loss, theft and unauthorized use, disclosure, or modification. However, We cannot guarantee its absolute security. No Internet, email, or mobile application transmission is 100% fully secure or error free. Email or other messages sent through the Platform may not be secure. You should use caution whenever submitting information through the Platform and take special care in deciding with which information You provide us. We cannot guarantee that transmissions of Your PII will be fully secure and that third parties will never be able to defeat our security measures or the security measures of our partners. WE ASSUME NO LIABILITY FOR DISCLOSURE OF YOUR INFORMATION DUE TO TRANSMISSION ERRORS, THIRD PARTY ACCESS, OR CAUSES BEYOND OUR CONTROL. Any information collected through the Platform is stored and processed in the United States. If you use our Platform outside of the United States, you consent to have your data transferred to the United States.

Data Retention Policy - Managing Your PII

Your PII will be retained as long as You use the Platform and for a reasonable time thereafter. We may maintain anonymized or aggregated data, including usage data, for analytics purposes. We may retain and use Your information as necessary to comply with our legal obligations, resolve disputes, and/or for the period required by laws in applicable jurisdictions. Please note that some or all of the information We have collected may be required for the Platform to function properly.

Your Choices Regarding Your Information

You have choices regarding the use of information by the Platform.

  • Updating Your PII - To change Your PII, You may in to Your account and access Your user profile. If You are unable to log into Your account, please contact us at privacy@p5leader.com.
  • Closing Your Account – You may close Your account by contacting us at  privacy@p5leader.com or in Your Platform User Profile. If the email account associated with Your email address is not active, We may close Your account without notice.

Data/Information Collected From 3rd-Party Websites & Mobile Applications and Do Not Track Policy

Your browser or device may offer You a “Do Not Track” option, which allows You to signal to operators of websites, web applications, mobile applications and services (including behavioral advertising services) that You do not wish such operators to track certain of Your online activities over time and/or across different websites or applications. Our Platform does not support Do Not Track requests at this time, which means that We or our analytics providers or other third parties with which We are working may collect information about Your online activity both during and after Your use of the Platform.

Underage Minors & Children

Our Platform is not intended for children under 18 years of age. We do not knowingly collect personal information from an individual under age 16. If You are under the age of 18, please do not submit any personal information through the Platform. If You have reason to believe that We may have accidentally received personal information from an individual under age 18, please contact us immediately at privacy@p5leader.com.
